1. Description of Service
EmuDeck Store is a digital distribution platform operated by EmuDeck SL (Tax ID: B70692900) that allows users to purchase and download homebrew video games for retro consoles, and developers to publish and sell their creations.
2. Account Registration
- An account is required to purchase paid games. Free games can be downloaded without registration.
- You are responsible for maintaining the confidentiality of your login credentials.
- The information you provide must be accurate and up to date.
- EmuDeck SL reserves the right to suspend or cancel accounts that violate these terms.
3. Purchases and Payments
- Prices are displayed in USD or EUR depending on the user's location. Users in the European Union will see prices with 21% VAT included.
- Payments are processed securely through PayPal and Stripe. EmuDeck SL does not store credit card data.
- Upon completing a purchase, the user obtains a personal, non-transferable license to download and use the purchased game.
- The minimum price for paid games is 1.00 USD/EUR.
4. Right of Withdrawal
In accordance with Article 103(m) of Spanish Royal Legislative Decree 1/2007, the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium when performance has begun with the consumer's prior express consent.
By purchasing a game and proceeding to download it, the user expressly agrees that the performance of the contract begins immediately, thereby waiving the right of withdrawal.

5. License of Use
- Purchasing a game grants a personal, non-exclusive, non-transferable license for private use.
- Redistribution, sublicensing, resale, or making purchased games publicly available is prohibited.
- Developers retain all intellectual property rights over their games.
6. Developer Terms
- Developers receive 80% of the sale price of each game. EmuDeck SL retains 20% as a platform commission.
- The minimum payout threshold is 50 USD, via PayPal Payouts.
- Submitted games are subject to an approval process. EmuDeck SL reserves the right to reject content that does not comply with the platform guidelines.
- Developers warrant that they hold the necessary rights to the content they publish and that it does not infringe on third-party rights.
7. Prohibited Content
Publishing games that meet any of the following criteria is not allowed:
- Infringe on third-party intellectual property rights.
- Contain malware, viruses, or other malicious code.
- Include illegal, defamatory content, or content that incites hatred.
- Are ROMs or copies of commercial games.
8. Service Availability
EmuDeck SL strives to keep the platform continuously available but does not guarantee uninterrupted service. Temporary interruptions may occur due to maintenance, updates, or force majeure.
9. Modifications
EmuDeck SL reserves the right to modify these terms and conditions at any time. Modifications will take effect upon publication on the website. Continued use of the platform after publication of changes implies acceptance thereof.
10. Applicable Law
These terms are governed by Spanish law. For the resolution of disputes, the courts of Madrid shall have jurisdiction, without prejudice to any jurisdiction that may apply to the consumer under applicable law.
